§ 1 Scope
These Terms of Use apply to the use of the “xLearning” app (the “App”) and the associated website,
operated by Reinmedia, Pascal-Francois Reinert (the “Operator”). By registering and using the App,
the user agrees to these Terms.
§ 2 Description of services
xLearning is a language-learning app. Among other things it offers:
- Vocabulary training (lists, cards, listening, quiz) with audio pronunciation
- Grammar training (conjugation, cases, plural and more)
- Pronunciation practice via speech input (speech-to-text)
- Optional courses from teachers, unlockable with a course code
- Cloud synchronisation of your own learning content
§ 3 Registration and account
- Use requires registration with a valid email address.
- Users are responsible for keeping their credentials confidential.
- As a rule, one account per person is intended.
- Minors may use the App only with the consent of a parent or guardian.
§ 4 Purchase, trial version and Family Sharing
- The App can be used in a free trial version (limited number of lists and words). The full
feature set is unlocked permanently via a one-time in-app purchase — no subscription.
- The purchase is processed via the Apple App Store; its terms and conditions apply.
- If App Store Family Sharing is enabled for the purchase, the unlock applies to the members of
the Apple family group according to Apple’s rules.
- Teachers’ courses are not sold within the App but unlocked via a course code (any purchase may
take place outside the App, directly with the teacher).
- Any statutory right of withdrawal for digital content remains unaffected; it may lapse once
performance has begun, in accordance with statutory provisions.
§ 5 Teachers and course content
- Teachers can create courses, lists and modules on the platform and release them to learners
via a code.
- The respective teachers are responsible for the accuracy and lawfulness of the content they upload.
- Content shared within a family/learning group is intended only for authorised members.
- The Operator may restrict or delete content or accounts without prior notice in the event of
legal violations.
§ 6 Third-party content
Third-party services are used to provide translation, text-to-speech and speech recognition (see
the Privacy Policy). Translations and automatic pronunciation are learning aids and may contain errors.
§ 7 Rules of use
- Users undertake not to use the App for unlawful purposes.
- Uploading unlawful, offensive or copyright-infringing content is prohibited.
- Manipulating content, progress or unlocks is prohibited.
§ 8 Limitation of liability
- The App is provided “as is”; uninterrupted availability or freedom from errors is not guaranteed.
- The Operator is not liable for damages arising from use, in particular not for incorrect
translations/pronunciation, data loss or technical faults.
- The limitation of liability does not apply in cases of intent or gross negligence, nor in the
event of injury to life, body or health.
§ 9 Account deletion
- Users may have their account and data deleted at any time (contact us by email, or use the
deletion page).
- On deletion, personal data is removed in accordance with the Privacy Policy.
§ 10 Changes to these Terms
- The Operator may amend these Terms; changes will be published in the App/on the website.
- Continued use after a change is deemed to constitute acceptance.
§ 11 Final provisions
- The law of the Federal Republic of Germany applies.
- Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
